Bill's Defense against Critics
|
There are various
conmen on the internet who have put up incorrect information about me in order to make themselves looks good. For almost
35 years, I have attempted to get people to stop paying conmen who advise them to do things that will get themselves
in terrible trouble and will not help them effectively wage the battle against the unfair and unconstitutional income
tax. Some of these conmen do not list their names, addresses or phone numbers. They don't want to be identified.
One of these conmen claims to be an attorney, although he offers no proof, and judging from his comments on my cases he didn't
learn how to read law. This particular conman states that I paid the IRS' bill rather than fight. It is true that I
paid the IRS in that situation in order to get jurisdiction in Federal Court to file a refund lawsuit. During the refund
lawsuit, the IRS settled out of court, rather than face trial. The IRS returned a majority of the funds. This
was not a published case as it was a settlement. Anyone who has questions about this issue is welcome to call me.

What they say and what I say

Conman Arguments
1.
Conklin is misrepresenting his victories against the IRS because none of the appellate victories on his website have anything
to do with the Fifth Amendment.
2. Conklin's Fifth Amendment approach has been ruled against by the
Supreme Court and other courts.
3. Conklin lost his claimed victories. 4. Conklin won his victories but they weren't significant. 5. You cannot argue that you are not required to
pay taxes because of the Fifth Amendment.
My Response
1. I have never once claimed on my website that any of my published
victories have anything to do with the Fifth Amendment.
2. It is true that the courts take the position
that you cannot refuse to file a return because of the Fifth Amendment. I do not suggest that anyone refuse to file
a return for any reason.
3. The definition of a published win is that the appellant overturns a case
he lost in the lower court. Four of my published wins are clear victories. One of my "wins" I actually lost
because of the anti-injunction act, but the Court granted an injunction in dicta by asserting that the IRS did not
have the authority to do what it was attempting to do. One of my wins was a joint win. I beat the government on their
issue and the government beat me on my issue. However, the case was later cited in a Supreme Court case on the issue
as an example of bad law. My case caused a conflict in the circuits and my original issue won. That is why I claim
that particular case to be a win.
4. Anyone
who doesn't think it is significant to beat the IRS on any issue in federal court has never litigated against the IRS.
I am quite proud of my victories. None of the conmen who are critical of me are sporting any victories on any
issue against any branch of government.
5. I do not assert in any of my writing that the Fifth
Amendment will protect you from paying income taxes. The IRS has draconian power. It can seize your wages, it
can seize your home and it can throw you out on the street to starve. It is the most powerful agency in the most powerful
country in the history of the world. It is the funding system for the most powerful military in the world. You
must deal with the IRS with great care.
